Terms and Conditions

1. Disclaimer

192.com Ltd (“192.com”) provides the 192.com service (“the Service”) to you on an 'as is' basis. Whilst we use our reasonable endeavours to ensure the accuracy of the information provided on the Service (“Information”), 192.com:

  1. does not warrant or guarantee the accuracy, reliability or legality of any of the Information;
  2. expressly disclaims all or any warranties, express or implied, relating to the Service, including in particular any warranties of merchantability or fitness for a particular purpose;
  3. will not be liable to you under any circumstances whatsoever for any direct, indirect, consequential, punitive or special damages arising from your use of the Service;
  4. reserves the right, at its discretion, from time to time to make changes to the Information provided on the Service, to alter the nature of the Service, to withdraw all or parts of the Service or to change these terms & conditions of use.
  5. hereby limits its financial liability to you to no more than the subscription fees received from you by 192.com in the twelve months preceding any claim.

You are therefore advised to check any Information provided to you through the Service as any reliance that you place on the accuracy of that Information is at your own risk.

2. Use of 192.com

The Service provides access to both free Information, which can be searched without the need to register and premium Information, for which you must register and purchase one of our credit or time limited packages. You can also purchase additional access rights enabling you to search archived edited electoral registers.

To ensure a high quality service for all customers, we enforce a "Fair Usage Policy" to ensure that users do not use the Services to an unacceptable level. Under this policy:

  • you may conduct up to 10 searches each day on free Information;
  • users that have purchased credit packages may conduct as many searches as their credit bank allows;
  • users that have purchased time limited packages may conduct as many searches as 192.com in its sole discretion considers to constitute reasonable use of the Service;

In the event that you breach this agreement by circumventing the service controls that prevent you from conducting more than 10 free searches per day, then you agree to pay the Data Extraction License Fees detailed in Clause 11.

3. Credit packages

In order for you to search premium Information such as the current Edited Electoral Roll; Births, Marriages and Deaths records; and Company and Director Reports you must choose one of our credit or time limited packages as offered from time to time. If you purchase a credit package your available credits will be reduced each time you conduct a search. Once you have used all of your credits you must purchase additional credits if you wish to continue searching premium Information. Credits purchased with the 6 credit package will expire one (1) month from date of purchase. Credits purchased with all other credit packages will expire six (6) months from date of purchase.

VAT is non refundable on all international orders.

4. Restrictions on Use of the Service

You may use Information for reasonable personal use or, in the case of a business, for internal purposes only. You may not sell, rent, lease, publish or display Information to any third parties. You may not integrate the Service into another intranet/extranet. You may not use automated scripts, software, spiders or any other automated means to perform searches on the Service. Any attempt to extract or download significant amounts of Information from the Service or to compile a database from Information obtained from the Service is strictly forbidden.

You are only entitled to use Information in fair, lawful and responsible ways and Information may not be used in any malicious, illegal or anti-social activity. We reserve the right to suspend any accounts where a user has supplied 192.com with a false email address or false personal data or where it comes to our attention that Information obtained from the service is being used in an inappropriate way.

You may not i) use Information to recreate, in whole or in part, any database, including the electoral roll or the directory enquiry database; or ii) use Information for direct marketing purposes; or iii) export or permit the export of any substantial amount of Information to a country which is not within the European Union; or iv) distribute any substantial amount of Information to third parties.

You agree that in relation to all Information derived from the Service you will comply with all applicable laws and codes of practice including the Data Protection Act 1998 and the Code of Practice on Telecommunications Directory Information Covering the Fair Processing of Personal Data (21 December 1998). You are warned that obtaining Information from the Service with the intention of using it for purposes other than allowed for in these terms & conditions may be an offence under Section 55 of the Data Protection Act 1998 and you should be prepared to justify your use of the Service to the relevant authorities.

You agree that if any complaint is made which relates to your use of Information you will assist 192.com and its data suppliers in investigating the complaint and You shall take such steps as are reasonably necessary to remedy the complaint as soon as possible.

5. Intellectual Property

The Information contained on the Service, the software used to operate it and the trade marks, logos and other intellectual property used in connection with it are the property of 192.com or have been licensed to 192.com. No licence of any such intellectual property rights is granted to you as a result of your use of the Service. Some of the telephone data provided on the Service is provided under license from British Telecommunications Plc. Through your use of the Service you shall have no rights in the BT trademarks nor any right to reproduce those trademarks on any material.

6. The Rights of 192.com

By using the Service you agree to these terms and conditions and you agree:

  1. to allow 192.com to Send you emails relating to your registration, purchases and account, including site upgrades;
  2. that if you elect to receive the 192.com Newsletter we will email you the regular 192.com Newsletter;
  3. that if you elect to receive 192.com Partner Offers we will also pass your information to very carefully selected partners of 192.com for specific and relevant promotions only (from which you can always opt-out). Email preferences can be changed from within the “Your Account” area of the Service.
  4. that 192.com may keep a log file of all searches, which can be made available to data subjects and/or the law enforcement authorities.
  5. to our Privacy Policy

Data subjects may request details of the information we hold on them, as laid out in the Data Protection Act. We will require proof of identity (such as a passport, utility bill or driver's licence). An administration charge of £10 will be applicable for such a request.

7. Protecting Your Security

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

  1. Permitted Use. Viewers of this information are granted permission to access this Crown copyright material and to download the Crown copyright material onto electronic, magnetic, optical or similar storage media provided that such activities are for private research, study or in-house use only. Any other use of the material requires the formal written permission of Land Registry which can be requested from Land Registry at Lincoln's Inn Fields, London, WC2A 3PH.
  2. Restricted Use. Viewers must not copy, distribute, sell or publish any of the Crown copyright material.

9. Aerial Photographs

You may use the aerial photographs that appear on 192.com for personal, non commercial purposes. Any use of the aerial photographs for commercial or business purposes is strictly prohibited.

10. Maps

The map images contain Ordnance Survey data which is protected by Crown copyright under the Copyright Design and Patent Act 1988. Unauthorised reproduction of map images infringes Crown Copyright and may lead to prosecution. You may use the map images that appear on the Service for personal, non commercial purposes. Any use of the map images for commercial or business purposes is strictly prohibited. You may print a maximum of 10 copies of any map image.

11. Data Extraction Licence Fees

Without prejudice to the restrictions on use of Information set out in these terms and conditions, if you circumvent the Service controls designed to prevent you from conducting more than 10 free searches per day in breach of this Agreement (whether automatically or manually) you agree to pay 192.com £0.9 per search and £0.1 for each record displayed in response to a search (“Data Extraction Fees“). You agree to provide a statement of usage to 192.com each day that your searches exceed 10 searches by fax to 0207 909 2152 detailing the number of searches conducted and the number of records displayed on the Service. In the event that you do not provide a statement of use then 192.com will calculate the number of searches conducted and the fees due based on its search logs, and you agree that the number of records displayed in response to each search will be calculated on the basis of 100 records per search. You agree to make payment within 7 days of receiving an invoice.
